By booking a service or rental with Posh Party, you (“Client”, “You”) agree to the following Terms of Service. These terms are designed to protect both you and Posh Party (“Company”, “We”, “Us”).
1. Bookings & Deposits
- A non-refundable deposit of 30–50% is required to secure your booking and rental items.
- Full payment is due no later than 3 days prior to your event unless otherwise agreed in writing.
- All bookings are subject to availability and are not confirmed until the deposit is received.
2. Cancellations & Rescheduling
- Cancellations made 7 or more days before the event may be eligible for a credit toward future services (minus the deposit).
- Cancellations made within 7 days of the event will result in forfeiture of the full payment.
- Rescheduling is allowed once per booking, subject to availability and must be requested at least 5 business days in advance.
3. Rental Periods & Returns
- Standard rentals are for a 24-hour period unless otherwise stated.
- Late returns may incur additional charges of $25+ per item/day.
- Items must be returned in the same condition they were delivered or picked up in.
4. Delivery & Setup
- Delivery is available within the Greater Toronto Area. Additional charges may apply depending on distance and accessibility.
- Client is responsible for ensuring clear and safe access for delivery and setup (e.g., no obstructions, stairs disclosed in advance).
- Setup and takedown are only included for specific items (e.g., backdrops, arches). Please confirm in your booking.
5. Damage, Loss & Liability
A refundable damage deposit may be required and will be returned within 5 business days if no damage, loss, or excessive cleaning is needed.
- The Client assumes full responsibility for all rented items from the time of delivery/pickup until return.
- Damaged, lost, or stolen items will be charged at replacement cost.
- Posh Party is not responsible for injuries or damages caused by misuse of rental items.
6. Weather & Outdoor Use
- It is the Client’s responsibility to provide weather protection for all items used outdoors.
- Damage due to rain, wind, or improper storage will be charged to the Client.
- Posh Party reserves the right to cancel or adjust services due to unsafe weather conditions for staff or equipment.
7. Photos & Promotion
- By booking with Posh Party, you grant permission for photos of your event setup to be used for marketing purposes (website, social media, portfolio).
- If you do not want your event featured, please notify us in writing prior to the event date.
8. Client Responsibilities
You agree to:
- Be available or have someone present during delivery/pickup.
- Follow all instructions for the safe and proper use of rental items.
- Notify us immediately of any issues with the rental items upon delivery.
- Ensure children are supervised around rental items at all times.
9. Liability Disclaimer
Posh Party will not be liable for:
- Delays due to weather, traffic, or circumstances beyond our control
- Injury, property damage, or accidents resulting from improper use of rented items
- Any indirect or consequential damages related to your event or rental
10. Privacy
We respect your privacy and handle your information in accordance with our Privacy Policy. We do not share your personal details without consent.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario. Any disputes will be handled in the courts of Toronto, Ontario.
